These Terms and Conditions govern your relationship with KW Scotland and the self-employed estate agent you engage to provide property services. Please read them carefully.

1. About KW Scotland
KW Scotland is a technology and training platform that supports self-employed estate agents trading under the Keller Williams brand. Each agent operates their own independent business and is responsible for all estate agency services they provide.

2. Our Role
KW Scotland:
• Provides technology, training, and marketing tools to self-employed estate agents;
• Offers brand licensing under the Keller Williams model;
• Is not a party to the agency agreement between you and your chosen agent;
• Does not list, sell, or let properties directly.
The estate agent you work with is your main point of contact and responsible for the handling of your transaction.

3. Agent Independence
Each agent is:
• Self-employed;
• Registered with a property redress scheme (usually the Property Redress Scheme (PRS) or The Property Ombudsman (TPO));
• Personally responsible for compliance with all relevant property legislation, including Anti-Money Laundering, CPRs, and GDPR;
• The data controller of any personal information you share with them during the transaction.
KW Scotland accepts no liability for the conduct, performance, or contractual obligations of individual agents.

4. Complaints Handling
If you are dissatisfied with the service you receive, please direct your complaint in the first instance to your individual estate agent.
If your complaint relates specifically to KW Scotland’s platform services (e.g. website, marketing materials, or internal systems), you can contact us in writing at:

We will follow our published Complaints Procedure, which includes access to the Property Redress Scheme if the issue is not resolved internally.

5. Use of Website and Digital Services
When using our website or digital tools:
• You agree not to misuse or interfere with our systems.
• Any property valuations provided online are indicative only and not a formal valuation.

6. Intellectual Property
All content on our website, including branding, graphics, and training material, is owned by KW Scotland or licensed from Keller Williams International and may not be copied or reproduced without permission.

7. Data Protection
• Your personal data will be handled in line with current UK GDPR and Data Protection Act 2018 requirements.
• Your estate agent is the data controller for your transaction.
• KW Scotland may act as a data processor, providing secure systems and support services.
• You have the right to request, amend, or delete your personal data. For more, see our Privacy Policy.

8. Limitation of Liability
KW Scotland accepts no liability for:
• Loss, damage, or cost incurred due to actions taken or not taken by your self-employed agent;
• Delays or disruption caused by third parties (e.g. conveyancers, surveyors, contractors, portals);
• Any financial loss or indirect damages, except where required by law.
This does not affect your statutory rights.

9. Third-Party Services and Referrals
Your agent may introduce you to third-party service providers such as solicitors, surveyors, or mortgage brokers. These services are entirely optional. If you choose to proceed, any agreement you make is between you and the provider.
KW Scotland or your agent may receive a referral fee. This will be disclosed to you in writing.

10. Governing Law
These Terms are governed by the laws of Scotland. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.

We reserve the right to amend these Terms at any time. Updated versions will be posted on our website. Continued use of our services constitutes your acceptance of any updated terms.
