Keller Williams Scotland – Buyer Terms & Conditions
1. Introduction

These Terms & Conditions (“T&Cs”) set out the basis on which Keller Williams Scotland (“KW Scotland”, “we”, “us”) provides property services to buyers. By using our services, registering your details, attending viewings, or making an offer on a property marketed by KW Scotland or its agents, you agree to these T&Cs.

2. About Us

Keller Williams Scotland operates as part of Keller Williams Worldwide. Our estate agents are self-employed business owners who operate under the KW Scotland model, supported by our Market Centres.

3. Our Role

We act as the selling agent on behalf of property owners (the “Seller”).

We introduce buyers to properties, arrange viewings, and handle negotiations between buyer and seller.

We do not act as a purchasing agent for buyers unless separately agreed in writing.

4. Buyer Responsibilities

You must provide accurate and truthful information when registering interest in a property (including proof of funds, mortgage in principle, or sale position).

You must inform us if your circumstances change (e.g. if you sell your property, lose finance, or change your buying position).

You must conduct yourself respectfully when attending viewings and engaging with sellers, tenants, or agents.

5. Viewings & Offers

Viewings are arranged by appointment only. You must notify your agent if you are unable to attend.

All offers must be made through KW Scotland and will be communicated promptly to the seller.

Submitting an offer does not guarantee acceptance. The seller retains the right to accept or reject any offer.

6. Compliance

KW Scotland complies with the Estate Agents Act 1979, the Property Ombudsman Code of Practice, and Anti-Money Laundering Regulations.

Before an offer can be formally accepted, buyers are required to provide identification and proof of funding in line with AML regulations.

KW Scotland is a member of the Property Redress Scheme (PRS).

7. Fees

Buyers do not normally pay fees to KW Scotland for purchasing a property unless engaged as a buyers agent.

Any exceptions (e.g. if you agree to use a specific service or buyer’s agent) will be disclosed clearly in writing before you commit.

You are responsible for your own legal, survey, mortgage, and other costs associated with the purchase.

8. Marketing & Communication

By registering with KW Scotland, you consent to us contacting you with details of properties that may be of interest.

You can opt out of marketing communications at any time by notifying us in writing or using unsubscribe options.

9. Liability

KW Scotland makes every effort to ensure property details are accurate. However, descriptions, measurements, and images are provided in good faith and should not be relied upon as statements of fact.

Buyers must satisfy themselves by viewing the property and instructing surveys, solicitors, and other professionals.

KW Scotland is not liable for loss, damage, or costs arising from reliance on property details, withdrawal of properties, or seller decisions.

10. Data Protection

KW Scotland complies with UK GDPR and Data Protection legislation.

We collect and process personal data only as necessary for property transactions and communication.

Your information will not be shared with third parties without your consent, except where required by law or compliance checks.

11. Termination

KW Scotland reserves the right to withdraw services if buyers act dishonestly, unlawfully, or in breach of these T&Cs.

You may withdraw your interest in a property at any time by notifying your agent.

12. Governing Law

These T&Cs are governed by the laws of Scotland, and any disputes shall be dealt with under the exclusive jurisdiction of the Scottish courts.
